5. Right of Withdrawal and Return of Goods of Satisfactory Quality
Consumers have the right, in cases provided for by applicable Lithuanian and European Union law, to withdraw from a distance sales contract within 14 days without giving a reason. The right of withdrawal is subject to the exceptions established by applicable law.
To exercise the right of withdrawal, the Customer must inform MB Patech of their decision by a clear statement sent to [email protected].
The Customer must send or return the goods no later than 14 days from the date on which the Customer informed MB Patech of the decision to withdraw from the contract.
Returns must be sent to:
MB Patech
Ateities g. 12
Sergeičikai II, Kaunas District
LT-54462, Lithuania
Returned goods must be properly and securely packaged. The Customer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
The direct costs of returning goods of satisfactory quality are borne by the Customer, unless otherwise required by applicable law.
MB Patech does not provide an additional voluntary return guarantee beyond the rights granted to consumers under applicable law.
6. Defective or Non-Conforming Goods
If the Customer receives damaged, defective, incorrect or otherwise non-conforming goods, the Customer should contact MB Patech at [email protected].
The Customer should provide the order information, a description of the issue and, where possible, photographs showing the defect or damage.
The rights provided to consumers under applicable Lithuanian and European Union law apply to defective or non-conforming goods.
Where the goods are found to be non-conforming, the remedies available under applicable law may, depending on the circumstances, include repair or replacement of the goods, a reduction in price, or termination of the contract and a refund.
Where the Seller is legally responsible for the costs of returning defective or non-conforming goods, such costs will be borne by MB Patech.
7. Refunds
Where a consumer validly exercises the right to withdraw from a distance contract, MB Patech will refund the amounts required by applicable law without undue delay and no later than 14 days from the date on which MB Patech is informed of the Customer's decision to withdraw from the contract.
Where permitted by applicable law, MB Patech may withhold the refund until the returned goods have been received or until the Customer provides evidence that the goods have been sent back, whichever occurs first.
Refunds will be made using the same means of payment that the Customer used for the original transaction.
Where applicable, the refund will also include the standard delivery costs required to be refunded under applicable law. If the Customer selected a more expensive delivery method than the standard delivery option offered by the Seller, the additional delivery costs resulting from that choice may not be refunded in accordance with applicable law.
8. Dispute Resolution
If the Customer has any questions, complaints or disputes concerning the goods or these Terms and Conditions of Sale, the Customer should first contact MB Patech:
Email: [email protected]
Address: Ateities g. 12, Sergeičikai II, Kaunas District, LT-54462, Lithuania
MB Patech will review consumer complaints and provide a reasoned response within the period required by applicable law.
If the dispute cannot be resolved directly with the Seller, the consumer may contact the State Consumer Rights Protection Authority of the Republic of Lithuania (VVTAT) for out-of-court consumer dispute resolution.
